Official acts

The President of the Republic of Poland shall issue decrees and rulings according to the principles set forth in Art. 92 and Art. 93 of the Constitution and shall issue decisions in respect of the implementation of his competences.

The President shall, using his constitutional and statutory competences, issue the official acts. The acts can be divided into two groups. The first group includes the acts which, in order to be valid, require the signature (countersignature) of the Prime Minister. By countersigning the acts, the Prime Minister shall accept the political responsibility for the particular act before the Sejm.

The official acts issued by the President which do not require the Prime Minister’s signature shall include:

  • Order for election to the Sejm and the Senate,
  • The convening of the first meeting of the newly elected Sejm and Senate,
  • The shortening of the Sejm term of office as prescribed by the Constitution,
  • The legislative initiative,
  • The order for the countrywide referendum,
  • Signing or refusal to sign acts,
  • Order to announce an act and the international agreement in the Journal of Laws of the Republic of Poland,
  • Address to the Sejm, the Senate or the National Assembly,
  • Applying to the Constitutional Tribunal,
  • Applying for carrying out the control before the Supreme Chamber of Control,
  • Designating and appointing the Prime Minister,
  • Accepting the resignation of the Council of Ministers and assigning it temporary performance of duties,
  • Applying to the Sejm for calling to account any member of the Council of Ministers before the State Tribunal,
  • Recalling the minister in whom the Sejm has passed a vote of non-confidence,
  • Convening the Cabinet Council,
  • Conferring orders and decorations,
  • Appointing the judges,
  • Exercising the right of pardon,
  • Conferring the Polish citizenship and giving consent to renounce the Polish citizenship,
  • Appointing the chief President of the Supreme Court,
  • Appointing the President and Deputy President of the Constitutional Tribunal,
  • Appointing the President of the Supreme Administrative Court,
  • Appointing the Presidents of the Supreme Court and the deputy presidents of the Supreme Administrative Court,
  • Applying to the Sejm for the appointment of the President of the National Bank of Poland,
  • Appointing the members of the Monetary Policy Council,
  • Appointing and recalling the members of the National Security Council,
  • Appointing the members of the National Broadcasting Council,
  • Conferring the statute to the President’s Chancellery and appointing and dismissing the Chief of the Polish President’s Chancellery,
  • Issuing rulings according to the principles laid down in Art. 93 of the Constitution of the Republic of Poland,
  • Act on the renunciation of the office of the President of the Republic of Poland.
